#PrivacyBREAKING: Austrian Supreme Court asks #CJEU if @Facebook illegally "undermined" the #GDPR by bypassing consent via an alleged "contract"!๐Ÿ˜ If so, they would not only have to stop processing data, but also pay damages to millions!๐Ÿ˜‰ โฉMore: noyb.eu/en/breaking-austrianโ€ฆ

If Facebook is vindicated in their interpretation of "contract", the conditions for consent in the GDPR are meaningless

Dass der OGH bei 2.-4. nach Auswertung der EuGH-Judikatur Zweifel hat, kann ich mir nicht erklรคren.

Curious to understand how the court argued that the use of FB would fall under household exemption (on the userโ€™s part). That seems to contradict with the Bodil Lindqvist decision.

Rectial 18 says social media is now household, IF only shared with friends. Problem is: Facebook uses the data further. OGH just said in a sentence the can't (when they do!) therefore not a problem. Seemed to me they passed that matter, but have to read it again.
